The US Consumer Product Safety Commission has issued a recall of Samsung Galaxy Note7 smartphones. There is a hazard where the lithium-ion battery in the Galaxy Note7 smartphones can overheat and catch fire, posing serious fire and burn hazard to consumers. Samsung is offering to replace or refund consumers who have these phones. There are approximately 1.9 million impacted phones, according to the USCPSC. Increased risk of stroke found in recent study

January 10, 2016 (FORT LAUDERDALE, FL) – Several department stores are reportedly continuing to sell allegedly faulty pressure cookers which can explode during use, causing extensive property damage and burn injuries. These pressure cookers appear to have several faulty parts or defects, including: a defective safety pin, a lid which can pop off during use, directional lettering on the valve which can melt off or disappear over time, a valve which can get stuck, 001and other possible defects.

A recent jury verdict in South Florida found a man guilty of murdering his newlywed wife to collect a $1 million insurance policy. The focus of the case against Michel Escoto, 42, was the charge of first-degree murder in the killing of wife Wendy Trapaga in October 2002 to collect the policy.  As was reported by the media, the couple returned from their honeymoon just a few days earlier. Wendy’s body was allegedly found in a trash bin in a parking lot.

The criminal case focused on punishing a man for committing a crime against the State of Florida. The family of the victim, however, may actually have recourse in a civil claim to recover the $1 million insurance policy for themselves. As a life insurance attorney, allow me to explain this in more detail.

Florida law has a little known statute, Florida Statute s. 732.802. That law says essentially that if you kill someone and were the beneficiary on their life insurance policy, you are deemed to have died before them and get skipped over on the insurance payout system. In the case of Mr. Escoto, depending on the policy’s language, it is very possible that the Estate of Wendy Trapaga, or any contingent beneficiary listed on the insurance policy application, may be entitled to collect the $1 million insurance policy.

In March 2015, a young man was driving his 2003 Honda Civic when he had a relatively minor, low impact car accident. Instantly, his Takata airbag deployed, sending shrapnel threw the airbag’s fabric and into the neck of the victim. The victim had blood pouring out of his neck, difficulty breathing, and a piece of metal lodged in his neck. He was airlifted to the emergency room for surgery to remove the piece of metal. He has significant scars on his neck where the surgery was performed. Our firm represents this victim.

Jason Turchin has represented many airbag victims and was one of the first attorneys to bring these issues to light.
